- This article examines how economic, emotional and social-power related factors affect victims' behaviour in favor of prosecution during police investigations. Data drawn from police records and police narrative reports indicated that mutual charge, dual arrest, the severity of assaults and the severity of injuries suffered by victims negatively affected the victims' behavior in favor of prosecution. These findings suggest that the norm of unequal relationships between men and women combined with an indiscriminate use of mutual charge and dual arrest without considering the defensive or offensive nature of violent acts can reduce trust in the criminal justice system among women victims of domestic violence and decrease the victims' interest in pursuing prosecution.

- The article critically examines Washington State's Predator Law (1990). The most controversial part of the law provides for the indefinite civil commitment of `sexually violent predators'. Under the legislation, husbands who victimize their wives and children cannot be defined as predators. The author argues that the social construction of predators as sick strangers is an ideological construct. This non-conspirators construct diverts attention from the fact that male intrafamilial violence is by far the greatest threat to the safety of women and children. These diversionary tendencies in the predator discourse constitute a hitherto scarcely publicized backlash against feminist arguments about the need for criminal laws that work in the interests of all women and childeren.

- In this issue on victimization among the family and its direct relations a report of a nation-wide study on domestic violence in the Netherlands. The cooperation of battered women as victims and witnesses is analyzed by examining experiences, opinions and perceptions of experts who deal most closely with batterd women in the United States. Female abusers of children are discussed and the way in which such cases are processed by the criminal justice system. 76 Cases of intimate femicide (killing of women by their intimate male partners) in Israel during 1990 and 1995 are investigated. The findings are put in a theoretical framework which assumes that violence in society will be positively related to stress factors and negatively related to support systems. Also the effects of and the victimization history of women in England and Wales on the likelihood of them receiving at least one obscene or nuisance phone call is being described.

Dowry giving is a customary practice in India, which often results in disputes between young wives and their new families. Using detailed data from 474 case records and interviews with 60 dowry victims, this study examines how women police stations serve as a dispute processing system, and describes the services extended by the stations to the victims of dowry disputes.

- Many feminists target ignorance of domestic violence as the main reason for judicial resistance to decisions that would punish abusers and redress battered women's harms. But feminist demands to educate courts - to create, for example, a reformed tort law system in which courts understand and take into account the complex situation of battered women litigants - seek an epistemological grounding from which to adjudicate the intractable contradictions in both legal discourse and cultural discourse about women. Domestic violence continues to co-exist with public condemnation of such violence by feminists and some lawmakers. Domestic violence is an open secret in our culture, fated to interface at common law with the open secret in American jurisprudence that the myth of an abstract rule of law is at the same time readily deconstructed, yet crucial and indispensable. Ignorance is not a cognitive darkness from which people emerge into the light of understanding. Rather, ignorance is pluralized and specified to correspond to various regimes of knowledge. For battered women, these regimes of knowledge include cultural mandates that women be intelligible in terms of pre-determined gender roles and sexual identities. For adjudicators, these regimes of knowledge include professional mandates to sustain the authority of precedent through appeals to a rule of law. The combination of (i) the utility to courts of an abstract rule of law, and (ii) social prescriptions for the intelligibility of women, fosters a privileged ignorance of violence against women that will not be erased through enlightenment.

- This article examines how gender construction operated in the recent cases of Sara Thornton and Kiranjit Ahluwalia. Their impact on the availability of criminal law defences to battered women who kill has already been thoroughly analysed. Equally significant, however, is the way in which the Court of Appeal constructed each woman and the story behind their killings so as to justify the disposal of their appeals. The cases also illustrate the complex relationship between gender construction and gender discrimination: how discrimination may flow from and reinforce gender constructions: and how the eradication of gender neutral bias may be replaced by a subtle process of gender construction in which female experiences and differences are considered, but in the form of sexist stereotypes which reinforce the oppression and control of women in general.

- This case note considers the availability in the U.K. of the provocation defence in cases of intimate homicide in the context of the recent House of Lords decision in R v. Smith [2000] 3 W.L.R. 654. The note argues that the expansion of the objective component of the defence to encompass the mental infirmities of individual defendants is dangerous for women. Although it has the potential to help some abused women who kill to use the defence, it has, at the same time, exposed women who are abused by sexually possessive, violent men to even greater danger. It is thus argued that the defence should be restricted in the way envisaged by the minority judgement of Lord Millett so that abused women will still be able to use the defence, but by a non-medical route. Alternatively, the defence should be abolished and defences which pose no risk of encompassing violent men should be developed to accommodate abused women.

- Some scholars argue that a greater number of women police officers may improve the plight of battered women through increased arrest rates and referrals to battered shelters. The authors examine how women and men police officers perceive and respond to a hypothetical realistic domestic violence situation, and three manipulated features of the situation: wife's conduct (normal, hallucinating, drunken), presence of visible injuries on the wife: and antagonism between wife and husband. Women and men did not differ on arrest rates: however, women were more likely to recommend battered shelters and less likely to recommend marriage counseling. These gender differences occurred only for experienced women. Women also assigned more importance to the victim's willingness to settle the argument in their arrest decisions.

The authors argue that not only has aggressive criminal justice intervention failed thus far to deliver on these promises but that it is, by its very nature, incapable of doing so. While its inability to do so is related to many factors which are discussed in the paper, perhapes the most significant is the multitude of harms that aggressive criminal justice intervention brings in tow for women, particularly those who are socially and economically marginalized.

- Sentencing practices in cases of domestic homicide have been the object of critical scrutiny on previous occasions across a number of jurisdictions. It has been suggested by some that these practices reveal judges to be taking a more lenient approach to women who kill their violent male partners than to men who kill allegedly unfaithful female partners. This note evaluates claims of gender bias in sentencing practices in UK cases of domestic homicide following the Court of Appeal sentencing decision in R. v. Suratan, R. v. Humes and R. v. Wilkinson (Attorney General's Reference No. 74, No. 95 and No. 118 of 2002) [2002] E.W.C.A. 2982 concerning three men who killed their female partners. It will argue that in the wake of this decision current proposals to review both the substantive law of provocation and sentencing practices are to be welcomed.

- As the experiences of black battered women with the police remain an underresearched issue, the current study focuses on the police arrest decision for these victims compared to other victims. Two important research questions are answered: is the arrest rate for black battered women significantly lower compared to other domestic violence victims, and are there different factors influencing the police decision to arrest for these victims compared to others? Using data from a medium-sized Midwestern police department, a model of the arrest decision was analyzed using logistic regression to compare the police response to black battered women versus 'other' victims. Results indicated that four variables differed to a significant extent across models: victim age, suspect age, victim had a probable drug or alcohol problem, and children present at the scene.

- This article examines historically the nature of medical 'experience' and the role of the expert witness in the trials of Canadian women charged with killing their - abusive male partners. The author argues that we can add conceptual depth to our reading of R. v. Lavallée and other contemporary cases where battered woman syndrome (BWS) is raised in a self-defence claim by looking to past practices of engaging medical expert opinion evidence in the courtroom and the historical development of psychiatric expertise in such cases. Within the context of Canadian legal history, this analysis reveals how 'new' medical-legal innovations, such as BWS not only reinvent old theories about women's behaviour but also perpetuate the artificial dichotomy between 'expertise' and 'common sense'. By turning the gaze inward and focusing on the courtroom, this analysis highlights a number of the more subtle legal processes that get in the way of correcting deep gender biases in the practice interpretation of Canadian law.

The 2004 Domestic Violence Crime and Victims Act has made a new offence of familial homicide, and the Act is designed to cover all violent home incidents, especially if they involve children or vulnerable adults. Programmes for perpetrators which adress violent behaviour and seek to change it are proving invaluable. The focus is also on another issue affecting families, women offenders. New initiative and cash have been made available to stop the cycle of reoffending, with the Home Office's Women's Offending Reduction Programme playing a key role.

- The effects of arrest in domestic violence have been debated since Professor Lawrence Sherman et al. published their widely cited empirical studies in the 1980s and early 1990s. These studies, however, focused on the perpetrator and did not consider the effects of arrest on the victim's willingness to report repeat violence to the police. In this article, the author argues that the effect of arresting the perpetrator on the behavior of the victim is a crucial factor in determining the overall effectiveness of arrest. It is likely that the arrest of the perpetrator deters violence, but it is equally possible that it encourages the victim to call the police in repeat incidents of violence. This article presents a rereading of the empirical studies. It argues that the effect of arrest on the victim should have been taken more seriously in the research design. It also suggests that a more convincing interpretation of the results is achieved when the victim is taken into account.

- New federal laws recognizing the civil rights implications of genderbased crimes represent an important development in effort to eliminate violence against women and other bias crimes generally. In enacting VAWA Civil Rights Remedy, Congress charted a compromise under which it required some circumstantial evidence of gender bias as a prerequisite to federal bias crime treatment. An analysis of cases of domestic violence and sexual assault, as well as an analysis of other bias crime cases, reveals the circumstantial evidence of the bias that animates violent crimes committed against women just as it does in other types of bias crime ceses.

Het blijkt dat er drie groepen stalkers te onderkennen zijn: een waarbij het zwart maken van het slachtoffer het voornaamste is, een tweede waarbij liefde verandert in haat en een derde waarbij sprake is van een gewelddadige confrontatie met de ex-partner.
