- This article examines the social and legal issues raised by the Supreme Court of Canada decision in Béliveau St-Jacques v. Fédération des employées et employés de services publics inc., which held that a worker, compensated under the Québec workers' compensation legislation, for disability arising from incidents including sexual harassment, was precluded from claiming compensatory, moral and punitive damages under the Québec Charter of Human Rights and Freedoms. After summarizing the Supreme Court decision, the authors consider the direct and indirect issues at stake in the case, both with regard to the rights of victims of sexual harassment and with regard to possible repercussions on the workers' compensation regime. They examine the specific role played by human rights tribunals in order to better evaluate the relevance of a policy which would prelude access to such tribunals for workers who are victims of sexual harassment: they then examine workers' compensation legislation as applied in cases involving sexual harassment, in order to determine the relevance of this remedy in certain cases. Finally, the authors look at the Québec Human Rights Tribunal's decisions since the Supreme Court ruling, and acknowledge the precarity of the current situation. They conclude with a proposal for a legislative amendment which would provide a more equitable and balanced solution to the current impasse.

- The author challenges the objective standard used to establish sexual harassment pointing out that this is a male standard that excludes the perspective of women. A review of the legislation and case law on sexual harassment in the workplace shows that the criteria currently used to establish sexual harassment is either the standard of the reasonable person, which legitimizes the male standard, or the standard of the reasonable victim, as interpreted and applied by men, which remains a male test. The author proposes an objective standard, namely a social standard, which would integrate the perspective of the reasonable woman and take into account the power relations between the alleged harasser and victim, so that characteristics that are relevant to the context, for example, age, 'race', sexual orientation or a victim's disability would become an essential point of the analysis.
