- California's AB 205 promises to bestow upon gay and lesbian couples many of the rights afforded to opposite-sex couples under State law. Despite its intentions AB 205 has created an air of uncertainty and apprehensiveness among California's registered domestic partners. The author analyses AB 205, contrasting its proposed effect with its likely interpretation and recommending revisions and describes the implications of creating legal relationships outside of a marriage paradigm. He argues that domestic partner legislation serves to undermine the fight for marriage by allowing for a compromise position which fails to deliver on the promise of equality.

- By including a special section on civil rights for women in the Violence Against Women Act (VAWA) American Congress created a federal remedy for victims of gender-motivated violence. Nevertheless the U.S. Supreme Court invalidated the civil rights provision, claiming that Congress lacked authority to pass this provision under the Commerce Clause and the 14th Amendment. This note argues that Congress has authority under the 13th Amendment to reinvigorate the civil rights remedy in the VAWA. Perone compares antebellum slavery to domestic violence to demonstrate how the 13th Amendment's prohibition of slavery provides a source of congressional authority for the VAWA's civil rights remedy.
