- Description
- The author argues how the Portuguese legal system’s efforts to determine paternity of children born outside legal marriage, automatically initiated by the Registry Office when a birth registration does not indicate the father, reveal cultural models which reinforce the naturalisation of the differences between mothers and fathers, with significant effects on the social construction of parental roles and on expectations of family organisation and female sexual behaviour.

- Description
- In Re D is the most recent in a line of cases to raise problems with the determination of legal fatherhood under s.28(3) of the Human Fertilisation and Embryology Act 1990. The author argues that the judgments in In Re D are interesting because they demonstrate the growing currency of the idea that a child has a right to ‘genetic truth’ and they also further evidence the ‘fragmentation of fatherhood’.

- Description
- In this paper the authors trace the historical exclusion of women from profession in Canada. They examine women's efforts to gain entry to law practice and their progress through the last century. The battle to gain entry to this exclusive profession took place on many fronts: in the courts, government legislature, public debate and media, and behind the closed doors of the law societies. After formal barriers to entry were dismantled, women continued to confront formidable barriers through overt and subtler forms of discrimination and exclusion.

- Description
- In Re G, the Court of Appeal awarded a joint residence order to the appellant, who was the lesbian ex-partner of the child’s full biological mother. The award also indirectly vested the appellant, a social parent, with parental responsibility and extended a body of case law to same-sex couples, which had until now only been applied to heterosexual couples. The author outlines the legal issues of the case in the context of the framework of parental responsibility set out in the Children Act 1989, putting forward a test of ‘parental fitness’ (which focuses on active ‘care’ as its central consideration) for social parents who must appeal to the court’s discretion to obtain parental responsibility. Secondly, the note offers a positive reading of Re G while highlighting a number of reservations centring upon continued legal preference for the ‘sexual family’. It is argued that while the legal recognition of ‘family diversity’ and parenthood remains modelled on this ‘sexual family’, the relaxation of family ‘boundaries’ will remain limited.

Ndashe positions the decision of the Supreme Court of Appeal (S.C.A.) in the context of the evolving case law of the Constitutional Court on sexual violence and questions its practical significance for addressing the prevalent abuse of women in South Africa.

- Description
- This case note reviews the guidelines issued by Morison J. in the Employment Appeal Tribunal at the end of the decision in 'Reed and Bull Information Systems Ltd v. Stedman (1999) IRLR 299. The author argues that while the judge's decision is to be welcomed in adopting an approach more sympathetic to victims of sexual harassment, it also raises a number of problems by placing a burden on the victim to place the harasser on notice that she does not welcome his conduct. The guidelines are likely to be usefully in any jurisdiction that has rules forbidding sexual harassment. The author considers the guidelines from both a practical and a doctrinal angle and indicates that the right to be free from sexual harassment is one that the courts are reluctant to protect like other civil rights.
