- This article examines how gender construction operated in the recent cases of Sara Thornton and Kiranjit Ahluwalia. Their impact on the availability of criminal law defences to battered women who kill has already been thoroughly analysed. Equally significant, however, is the way in which the Court of Appeal constructed each woman and the story behind their killings so as to justify the disposal of their appeals. The cases also illustrate the complex relationship between gender construction and gender discrimination: how discrimination may flow from and reinforce gender constructions: and how the eradication of gender neutral bias may be replaced by a subtle process of gender construction in which female experiences and differences are considered, but in the form of sexist stereotypes which reinforce the oppression and control of women in general.

- Aggressive criminal justice intervention in cases of wife abuse, characterized in particular by mandatory charging and no-drop prosecutorial policies, is frequently held out as offering two broad promises to women: protection for individual women experiencing wife abuse: and the transformation of the norms which currently sustain men's violence against women. The authors argue that not only has aggressive criminal justice intervention failed thus far to deliver on these promises but that it is, by its very nature, incapable of doing so. While its inability to do so is related to many factors which are discussed in the paper, perhapes the most significant is the multitude of harms that aggressive criminal justice intervention brings in tow for women, particularly those who are socially and economically marginalized.

De politie blijkt eerder tot arrestatie over te gaan wanneer de slachtoffers gewond zijn, de dader geen voorgeschiedenis van geweld heeft en bij incidenten waarin zwarte daders zwarte slachtoffers maken. Ook wordt ingegaan op het `battered woman syndrome'.

Uit interviews met politiefunctionarissen bleek dat, hoewel de respondenten verklaarden altijd hun uiterste best te doen, zij zich vaak belemmerd voelen door bureaucratische werkwijzen en andere organisaties. Zij brachten over het algemeen conservatieve attitudes tot uitdrukking wat betreft huwelijk en gezinsgeweld. In de interviews kwam een beeld van vrouwen naar voren als zijnde onbetrouwbaar omdat het slachtoffer in de rechtszaal opeens niet blijkt te willen of te durven meewerken. Maar toen de auteur in de rechtbankverslagen dit feit op zijn juistheid controleerde, bleek dat slechts een op de tien vrouwen als niet-meewerkend werd omschreven.
