Gender-based asylum claims and non-refoulement
Collection of papers on the Istanbul Convention on preventing and combating violence against women and domestic violence. The Council of Europe Convention (the Istanbul Convention) contains provisions specific to asylum-seeking and refugee women in order to prevent and combat all forms of violence against women, including domestic violence. The publication aims to support policy makers, border and immigration officials and practitioners with the implementation of Articles 60 (Gender-based asylum claims) and 61 (Non-refoulement) of the Istanbul Convention. The subjects include among others definitions, information and examples of gender-based violence that may be recognised as forms of persecution or other serious harm and how to ensure that a gender-sensitive interpretation is given to each of the convention grounds.- Creator

Making Europe better for women
'Gender equality is one of the fundamental principles of the European Union (EU), with its founding Treaty of Rome (1957) already including an article on equal pay for men and women. Since then, the EU has aimed at equal opportunities and treatment for both sexes adopting a dual approach of gender mainstreaming and specific measures, such as legislation, awareness-raising campaigns or financial programmes. Nevertheless, a recent monitoring report shows that the EU’s strong commitment to gender equality remains largely rhetorical, with implementation records varying heavily among Member States.'- Creator

To legalize or to criminalize?
'This research focuses on heterosexual Dutch male attitudes towards the sex industry. The purpose was to explore how their cultural environment may provide a different script for sexuality development and therefore different opinions on legalization or criminalization of prostitution. The goal was to answer the question of whether or not Dutch males, compared to men interviewed in previous research, developed a different attitude towards sex work and sex workers within the context of legal prostitution and more comprehensive sex education, both of which aid in creating a cultural script that impacts sexuality development. Four Dutch males were interviewed along with one former sex worker. In the analysis, the results were compared to prior research to determine commonalities and differences. Conclusions illustrated an increase in support for legal prostitution, different reasons for utilizing services, a recognition of buying sex services as more common and less associated with criminal activity.'- Creator

Violence against women and the law
This book examines the strength of laws addressing four types of violence against women - rape, marital rape, domestic violence, and sexual harassment - in 196 countries from 2007 to 2010. It analyzes why these laws exist in some places and not others, and why they are stronger or weaker in places where they do exist. The authors have compiled original data that allow them to test various hypotheses related to whether international law drives the enactment of domestic legal protections. They also examine the ways in which these legal protections are related to economic, political, and social institutions, and how transnational society affects the presence and strength of these laws.- Creator

Through presenting good practices and providing tools on how to shape migration processes, the Guide aims to assist and encourage OSCE participating States and Partners for Co-operation to enforce current legislation as well as develop and adopt policies and programmes for female migrant workers that are more gendersensitive. Gender mainstreaming and gender equality in Europe
This book provides a systematic scientific overview of gender mainstreaming in Europe. It recalls the main steps of the origins and the development of the European gender mainstreaming (GM) strategy. The book also connects this framework with the current situation of gender equality and explores the strength and weak points of the strategy. To do so, it provides a critical evaluation of the instruments used to measure gender equality and explores how societal aspects, such as the opportunity structure defined by work-family balance policies and practices, affect the individual values of gender equality supporting the development of gender egalitarian cultures. Further, it develops an outline of the current and future challenges of the gender mainstreaming strategy, that run in parallel with the general European Union’s challenges, such as the integration process, economic crisis, migration and refugees crisis, and the rise of right-wing Euroscepticism. Follow-up study of the research project Prostitution i Norden. It focuses on knowledge about young people’s experiences of sex for compensation in the Nordic countries. Of each country (Denmark, Finland, Iceland, Norway and Sweden) are described the existing knowledge about such experiences, the way social initiatives address young people' needs for selling sex and relevant legal measures. Although young people in prostitution are vulnerable, results show that the Nordic countries offer few specifically targeted social initiatives to this group.- Creator

GREVIO’s (Baseline) evaluation report on legislative and other measures giving effect to the provisions of the Council of Europe Convention on Preventing and Combating Violence against Women and Domestic Violence (Istanbul Convention) Netherlands
This report of GREVIO evaluates laws and policies on violence against women in the Netherlands. It describes different measures that have been taken to build a set of policies and services to help victims of domestic violence. The report argues that, under the Istanbul Convention, all forms of violence against women require a holistic approach in the form of prevention, protection of victims and prosecution. It notes that sexual assault, rape, forced marriage and other forms of violence against women are less prominently addressed through law and policy - and even less so on the basis of a gendered approach. The Istanbul Convention requires a gendered understanding of rape to better capture the many ways in which women experience sexual violence - most of which do not involve force, threat or coercion. -

'In maart 2009 is de ‘Wet bevordering voortgezet ouderschap en zorgvuldige scheiding’ in werking getreden. Een van de onderdelen van deze wet is dat alle scheidende ouders die gezamenlijk het gezag hebben over minderjarige kinderen vanaf die datum een ouderschapsplan moeten voorleggen aan de rechter. Dit ouderschapsplan moet afspraken bevatten over de verdeling van zorg- en opvoedingstaken, informatie-uitwisseling over de kinderen en kinderalimentatie. De doelstelling van het ouderschapsplan is conflicten over deze aspecten te beperken door ouders te verplichten hier voorafgaand aan de scheiding formele afspraken over te maken. Dit zou de nadelige gevolgen van een scheiding voor kinderen moeten verminderen. Deze rapportage geeft een eerste aanzet tot een evaluatie van deze wet. Het omvat geen uitgebreid evaluatieonderzoek maar maakt zoveel mogelijk gebruik van bestaande data en literatuur. Voor een uitgebreidere evaluatie wordt verwezen naar toekomstige resultaten van verschillende lopende universitaire projecten.'- Creator

Women’s participation and gender considerations in country representation, planning and reporting to the BRS Conventions
The Basel, Rotterdam and Stockholm (BRS) Conventions cooperate to protect human health and the environment from the negative effects of pollution. This analysis explores how women are represented as delegates to the Conferences of the Parties (COPs), members and observers of Conventions’ Subsidiary Bodies and National Implementation Plans (NIPs). It also studies how gender equality considerations are included in Parties’ reports to the BRS Conventions and in the Rotterdam Prior Informed Consent (PIC) Circular. Results illustrate an improvement in women’s participation in key decision-making processes and the inclusion of gender considerations within initial NIPs. Yet, parties not yet fully integrate or mainstream gender considerations within their planning and reporting documents.- Creator

It is primarily based on desk research carried out in five European Union (EU) Member States: France, Germany, the Netherlands, Sweden and the United Kingdom. -

Since 2014, the Istanbul Convention is a European legal instrument to prevent and combat violence against women and domestic violence as a violation of human rights. The publication describes the aims of the Istanbul Convention, its added value and its application. It also explains the Convention's notion of 'gender-based' violence, eliminating gender stereotypes in education and the non-discrimination principle regarding gender identity.
