Gender-based asylum claims and non-refoulement
Collection of papers on the Istanbul Convention on preventing and combating violence against women and domestic violence. The Council of Europe Convention (the Istanbul Convention) contains provisions specific to asylum-seeking and refugee women in order to prevent and combat all forms of violence against women, including domestic violence. The publication aims to support policy makers, border and immigration officials and practitioners with the implementation of Articles 60 (Gender-based asylum claims) and 61 (Non-refoulement) of the Istanbul Convention. The subjects include among others definitions, information and examples of gender-based violence that may be recognised as forms of persecution or other serious harm and how to ensure that a gender-sensitive interpretation is given to each of the convention grounds.- Creator

This report of GREVIO evaluates laws and policies on violence against women in the Netherlands. It describes different measures that have been taken to build a set of policies and services to help victims of domestic violence. The report argues that, under the Istanbul Convention, all forms of violence against women require a holistic approach in the form of prevention, protection of victims and prosecution. It notes that sexual assault, rape, forced marriage and other forms of violence against women are less prominently addressed through law and policy - and even less so on the basis of a gendered approach. The Istanbul Convention requires a gendered understanding of rape to better capture the many ways in which women experience sexual violence - most of which do not involve force, threat or coercion. -

Since 2014, the Istanbul Convention is a European legal instrument to prevent and combat violence against women and domestic violence as a violation of human rights. The publication describes the aims of the Istanbul Convention, its added value and its application. It also explains the Convention's notion of 'gender-based' violence, eliminating gender stereotypes in education and the non-discrimination principle regarding gender identity. -

This document suggests how international human rights standards might be applied to issues regarding unwanted pregnancy and abortion-related care. Part 1 introduces the international sources of human rights, explaining how international conventions are adopted and how their implementation by States is monitored. It also describes the legal status of international consensus statements. Part 2 introduces the right to health as defined in international treaties and describes the sexual and reproductive rights which are commonly acknowledged by legal scholars and international agencies. Part 3 provides suggestions on how NGOs and health providers can increase awareness about, and promote compliance with, sexual and reproductive health rights, particularly regarding unwanted pregnancy and abortion-related care. Part 4 presents case studies demonstrating possible violations of women’s reproductive rights. -

The trafficking of children for purposes of sexual exploitation - South Africa
Research on the sexual exploitation of children through trafficking. The primary focus is on socio-economic structural conditions in South Africa that provide the push and pull for the increase in child prostitution. Next to in-country trafficking, also cross-border trafficking is researched. Another focus is on adults (parents and gangs) who are responsible for facilitating the child's involvement in the exchange of sex for money or items. The report also provides a voice to children who have experienced such sexual exploitation. And it highlights international, continental and national legal measures taken in the areas of child prostitution, trafficking of children for this purpose, pornography, sex tourism and extra-territorial legislation.- Creator
