- Description
- This book reconsiders a reliance on the criminal justice system for solving women’s struggles with domestic violence: acknowledge how militarism subjects women to extreme levels of violence perpetrated from within, and without, their communities: recognize how the medical establishment inflicts violence—such as involuntary sterilization and inadequate health care—on women of color: devise new strategies for cross-cultural dialogue, theorizing and alliance building. .INCITE! Women of Color Against Violence was born in 2000, when more than two thousand activists from diverse communities came together to end the war being waged on women of color in the US and around the world. Now the largest multiracial, grassroots, feminist organization in the United States, INCITE! boasts chapters in more than 20 cities.

- Constitutionalism affirms the idea that democracy should not lead to the violation of human rights or the oppression of minorities. This book aims to explore the relationship between constitutional law and feminism. The contributors offer a spectrum of approaches and the analysis is set across a wide range of topics, including both familiar ones like reproductive rights and marital status, and emerging issues such as a new societal approach to household labor and participation of women in constitutional discussions online. The book is divided into six parts: I) feminism as a challenge to constitutional theory: II) feminism and judging: III) feminism, democracy, and political participation: IV) the constitutionalism of reproductive rights: V) women's rights, multiculturalism, and diversity: and VI) women between secularism and religion

- Description
- Informed in 1944 that she was “not of the sex” entitled to be admitted to Harvard Law School, African American activist Pauli Murray confronted the injustice she called “Jane Crow.” In the 1960s and 1970s, the analogies between sex and race discrimination pioneered by Murray became potent weapons in the battle for women’s rights, as feminists borrowed rhetoric and legal arguments from the civil rights movement. This book explores the development and consequences of this key feminist strategy.Mayeri uncovers the history of an often misunderstood connection at the heart of American antidiscrimination law. Her study details how a political and legal climate transformed the links between race and sex equality, civil rights and feminism. Battles over employment discrimination, school segregation, reproductive freedom, affirmative action, and constitutional change reveal the promise and peril of reasoning from race—and offer a vivid picture of Pauli Murray, Ruth Bader Ginsburg, and others who defined feminists’ agenda.

- In this biography De Hart explores the central experiences that shaped Ginsburg’s passion for justice, her advocacy for gender equality, her meticulous jurisprudence: her desire to make We the People more united. At the heart of her story and abiding beliefs is her Jewish background. She grew up during the Holocaust and World War II. Her mother, Celia Amster Bader inspired her daughter’s feminism, insisting that Ruth become independent. She founded the Women's Rights Law Reporter, writing the brief for the first case that persuaded the Supreme Court to strike down a sex-discriminatory state law, then at Columbia (the law school’s first tenured female professor): becoming the director of the women’s rights project of the ACLU, persuading the Supreme Court in a series of decisions to ban laws that denied women full citizenship status with men.

- This collection avoids the ‘reductionist' and 'essentialist' shortcomings of ‘feminism unmodified’ in rediscovering’ the peculiarity of feminist perspectives. In the introductory chapter, summarizing the state of the law on core aspects of sexuality and providing a critical appraisal of the key themes and concerns, the book analyzes and transcends the traditional dichotomised thinking about the regulation of gender issues. It addresses a broad range of key themes including: crime, the family and child, contract law, jurisprudence, public and international law.

- Description
- The author argues that the feminist campaign to stop sexual violence has entered into a problematic alliance with the neoliberal state. She chronicles the evolution of this alliance by examining the history of the anti-violence campaign, the production of cultural images about sexual violence, professional discourses on intimate violence, and the everyday lives of battered women. She also scrutinizes the rhetoric of high-profile rape trials and the expansion of feminist concerns about sexual violence into the international human-rights arena. In the process, Bumiller reveals how the feminist fight against sexual violence has been shaped over recent decades by dramatic shifts in welfare policies, incarceration rates, and the surveillance role of social-service bureaucracies.

- Description
- Among the many tools feminist legal theorists have given scholars is that of anti-essentialism: women are not created equal, and privilege varies by circumstances, particularly that of race and class. At the same time, feminist legal theory tends to view men through an essentialist lens, in which men are created equal. The study of masculinities, inspired by feminist theory to explore the construction of masculinity, questions the real circumstances of men to explore how privilege is constructed. In this book Nancy Dowd looks at the anti-essentialist model to the study of masculinities. She demonstrates how men's treatment by the law and society in general varies by race, economic position, sexuality, and other factors. She applies these insights to both boys and men, examining how masculinities analysis exposes both privilege and subordination. She examines men's experienceof fatherhood and sexual abuse, and boys’ experience in education and juvenile justice.

- Description
- In this book, a group of feminist legal scholars put theory into practice by writing the 'missing' feminist judgments in key cases. The cases chosen are significant decisions in English law across a broad range of substantive areas. Each case is accompanied by a commentary which renders the judgment accessible to a non-specialist audience. The commentary explains the original decision, its background and doctrinal significance, the issues it raises, and how the feminist judgment deals with them differently. The book also includes chapters examining the theoretical and conceptual issues raised by the process and practice of feminist judging, and by the judgments themselves, including the possibility of divergent feminist approaches to legal decision-making.

- Description
- Prior to European colonialism, Igboland, a region in Nigeria, was a nonpatriarchal, nongendered society governed by separate but interdependent political systems for men and women. In the last one hundred fifty years, the Igbo family has undergone vast structural changes in response to a barrage of cultural forces. Critically rereading social practices and oral and written histories of Igbo women and the society, Nkiru Uwechia Nzegwu demonstrates how colonial laws, edicts, and judicial institutions facilitated the creation of gender inequality in Igbo society. Nzegwu exposes the unlikely convergence of Western feminist and African male judges’ assumptions about 'traditional' African values where women are subordinate and oppressed. Instead she offers a conception of equality based on historical Igbo family structures and practices that challenges the epistemological and ontological bases of Western feminist inquiry.

- Description
- In the late 1970s, feminist scholars and activists joined together to build a movement aimed at bringing feminist theory and experiences to the practice and teaching of American law. Since then, the feminist jurisprudence movement has taken root, with courts and legislatures addressing matters of sex and gender inequality, and law schools employing feminist and post-feminist theory in the classroom. This book situates the feminist jurisprudence movement within the larger context of Western law and philosophy, focusing first on common problem areas of legal theory and decision-making, and then explaining how feminist jurisprudence can analyze and address these issues in new ways.

Through readings of movies made between 1928 and 2001 in Europe, Japan and the United States, the author argues that in representing 'gender crimes' films have constructed a cinematic jurisprudence, training audiences worldwide in patterns of judgment of women (and men) in such situations.

- This book on the critical area of land law from a feminist perspective, provides an original and critical analysis of the gendered intersection between law and land: ranging land use and ownership in England and Wales to Botswana, Papua New Guinea and the Muslim world. The authors draw upon the diverse disciplinary fields of law, anthropology and geography to open up perspectives that go beyond the usually narrow topography and cartography of land law. Addressing an unorthodox variety of sites where questions of women's access and rights to land are raised, this book includes chapters on: shopping malls, ancient monuments, nature reserves, housing estates and the family home.
