- By including a special section on civil rights for women in the Violence Against Women Act (VAWA) American Congress created a federal remedy for victims of gender-motivated violence. Nevertheless the U.S. Supreme Court invalidated the civil rights provision, claiming that Congress lacked authority to pass this provision under the Commerce Clause and the 14th Amendment. This note argues that Congress has authority under the 13th Amendment to reinvigorate the civil rights remedy in the VAWA. Perone compares antebellum slavery to domestic violence to demonstrate how the 13th Amendment's prohibition of slavery provides a source of congressional authority for the VAWA's civil rights remedy.

- Humphrey explores the evolution of the status offense and its negative impact on the general population of youthful offenders, particularly girls, and the link between running away and the experience of physical and sexual abuse. She argues that although abuse histories are the norm among delinquent girls the role of these histories is downplayed as a key to addressing delinquency issues. It is only when these are taken into account that girls's status offenses and delinquency issues can be addressed. She suggests alternatives to status offense arrest and detention.
