- De werkgroep Staatsrecht van het NJCM organiseerde op 11 november 2004 een studieavond 'Gelijke behandeling: wie houdt het toezicht? Een nationaal en Europees perspectief' naar aanleiding van het verschijnen van 'Groenboek' door de Europese Commissie, Equality and non-discrimination in an enlarged European Union. Het Groenboek gaat onder andere over de vraag op welke manier regels over gelijke behandeling op effectieve wijze kunnen worden geïmplementeerd. Alex Geert Castermans en Jenny E. Goldschmidt geven hun visie over de vraag hoe de Nederlandse gelijkebehandelingswetgeving effectiever kan worden gemaakt en welk orgaan het toezicht hierop moet uitoefenen. Alex Geert Castermans gaat in op de vraag of een bredere aanpak van de bescherming tegen ongelijke behandeling op zijn plaats is. Jenny E. Goldschmidt stelt dat de Commissie Gelijke Bhenadeling goed functioneert, maar vraag zich af of de commissie zich over alle gevallen van ongelijke behandeling moet blijven uitspreken. Goldschmidt ziet voor een mensenrechtencommissie vooral een taak weggelegd op het terrein van gelijke behandeling als het gaat om advisering, voorlichting en deskundigheidsbevordering.

- This analysis of the case Gonzalez v. United States Air Force contains in part I a brief background of the Federal Tort Claims Act (FTCA), the Ferez Doctrine, which states that almost every injury that occurs to a service member arises directly out of his of her military service, the plaintiff's claim in the Gonzalez case and the decision of the Tenth Circuit. Part 2 describes how civilian courts have expanded the meanig behind the Feres doctrine and argues that Feres should not have barred the plaintiff's claim in Gonzalez. Part 3 discusses why the discretionary function and intentional tort exceptions to the FTCA should not bar the plaintiff's claim and explains why the Ninth Circuit's negligent hiring analysis would have been appropriate in Gonzalez. This comment concludes that the Tenth Circuit could have decided Gonzalez differently and allowed the plaintiff the opportunity to argue the merits of her case had the court not dismissed the case on a jurisdictional technicality.

- This paper explores the trend of sexual violence against women that emerged in Pakistan with the introduction of the Islamization process through the implementation of the Sharia laws since 1979. The focal pont is rape and the state legislation that governs it, namely the Zina Hudood Ordinance and the Law of Evidence, and how the gender-discriminatory nature of these laws serves as a powerful weapon in the hands of the patriarchal society of Pakistan to suppress women. These laws and their rigid interpretation in the name of Islam have not only furthered oppression and sexual violence against women to an alarming degree in Pakistan, but also seriously destroyed women's chances of equal justice. The factors that led to the implementation and survival of such laws in the first place, and consequently how rape became a intimidating weapon against women, are discussed. The paper examines the various political, social, cultural and religous factors that contribute to this situation, and the legal and social complexities involved for women in seeking justice in rape cases. In conclusion Pakistani women's initiative in evolving and building an organized resistance and struggle for the cancellation of gender discriminatory laws are discussed.

- In Re G, the Court of Appeal awarded a joint residence order to the appellant, who was the lesbian ex-partner of the child’s full biological mother. The award also indirectly vested the appellant, a social parent, with parental responsibility and extended a body of case law to same-sex couples, which had until now only been applied to heterosexual couples. The author outlines the legal issues of the case in the context of the framework of parental responsibility set out in the Children Act 1989, putting forward a test of ‘parental fitness’ (which focuses on active ‘care’ as its central consideration) for social parents who must appeal to the court’s discretion to obtain parental responsibility. Secondly, the note offers a positive reading of Re G while highlighting a number of reservations centring upon continued legal preference for the ‘sexual family’. It is argued that while the legal recognition of ‘family diversity’ and parenthood remains modelled on this ‘sexual family’, the relaxation of family ‘boundaries’ will remain limited.

- The author argues that the limited scope of application of the Directive (the first European Community instrument to implement the principle of gender equality outside the workplace),together with doubts surrounding its legal base and position within the overall gender equality framework of the Union, have undermined its potential. Nevertheless, it is suggested that for the future, should these criticisms be adequately addressed, then the Directive may provide an important platform for the wider diffusion of the gender equality principle beyond the sphere of European employment law.
