- This article examines how economic, emotional and social-power related factors affect victims' behaviour in favor of prosecution during police investigations. Data drawn from police records and police narrative reports indicated that mutual charge, dual arrest, the severity of assaults and the severity of injuries suffered by victims negatively affected the victims' behavior in favor of prosecution. These findings suggest that the norm of unequal relationships between men and women combined with an indiscriminate use of mutual charge and dual arrest without considering the defensive or offensive nature of violent acts can reduce trust in the criminal justice system among women victims of domestic violence and decrease the victims' interest in pursuing prosecution.

- This case note considers the availability in the U.K. of the provocation defence in cases of intimate homicide in the context of the recent House of Lords decision in R v. Smith [2000] 3 W.L.R. 654. The note argues that the expansion of the objective component of the defence to encompass the mental infirmities of individual defendants is dangerous for women. Although it has the potential to help some abused women who kill to use the defence, it has, at the same time, exposed women who are abused by sexually possessive, violent men to even greater danger. It is thus argued that the defence should be restricted in the way envisaged by the minority judgement of Lord Millett so that abused women will still be able to use the defence, but by a non-medical route. Alternatively, the defence should be abolished and defences which pose no risk of encompassing violent men should be developed to accommodate abused women.

- The effects of arrest in domestic violence have been debated since Professor Lawrence Sherman et al. published their widely cited empirical studies in the 1980s and early 1990s. These studies, however, focused on the perpetrator and did not consider the effects of arrest on the victim's willingness to report repeat violence to the police. In this article, the author argues that the effect of arresting the perpetrator on the behavior of the victim is a crucial factor in determining the overall effectiveness of arrest. It is likely that the arrest of the perpetrator deters violence, but it is equally possible that it encourages the victim to call the police in repeat incidents of violence. This article presents a rereading of the empirical studies. It argues that the effect of arrest on the victim should have been taken more seriously in the research design. It also suggests that a more convincing interpretation of the results is achieved when the victim is taken into account.

- Strong punitive measures and an aggressive criminal justice response have been at the forefront of contemporary approaches to domestic violence across Canada. If current justice policies in Canada are taken as an indicator of the needs of women in abusive relationships, then women are calling for a 'get tough' approach to domestic violence, including amplified police surveillance, harsher punishments for male abusers, and an extension of criminal law. Is this what female victims of abuse are seeking? This article re-introduces women's needs as a significant component in the analysis of the successes and/or failures of the criminal justice response to woman abuse. The article is based on qualitative interviews conducted with women who have been victimized by intimate violence and have called upon the criminal justice system for assistance. The main objective was to learn what the women identified their needs to be and whether, if at all, the criminal justice system responded to those needs. The interview data were used to analyze the extent to which, and the manner in which, the criminal justice system responded to the needs they articulated and then to consider whether the criminal justice system is structurally capable of responding to these needs. A re-thinking of 'women's needs' and a clarification of the corresponding notion of 'choice' emerged from this analysis.
