Samenvatting | Part I of this work examines how failure-to-protect statutes' disparate impact on women is the result of a legal backlash against the growing independence of women. Part II examines the traditional backdrop upon which failure-to-protect laws have been promulgated and interpreted and contrasts this backdrop with the modern trends ignored by these laws. Finally, Part III suggests how legislatures and the judiciary can better serve the best interests of abused children and mothers. |
